    1. scope

      The following terms and conditions apply to all orders via our online shop.

    2. Contractual partner, conclusion of contract

      The purchase contract is concluded with upparel GmbH. By placing the products in the online shop, we make a binding offer to conclude a contract for these items. You can first place our products in your shopping cart without obligation and correct your entries at any time before submitting your binding order by using the correction aids provided and explained in the ordering process. The contract is concluded when you accept the offer for the goods contained in the shopping cart by clicking on the order button. Immediately after submitting the order, you will receive another confirmation by email.

    3. Contract language, contract text storage

      The languages ​​available for concluding the contract are German and English. We save the contract text and send you the order details and our general terms and conditions by email. You can view and download the terms and conditions here on this page at any time. You can view your past orders in our customer login.

    4. delivery terms

      In addition to the stated product prices, there are shipping costs. You can find out more about the shipping costs in the offers.

    5. pay

      The following payment methods are generally available to you in our shop:

      • Payment in advance

        If you choose the advance payment method, we will give you our bank details in a separate email and deliver the goods after receipt of payment.

      • Instant bank transfer

        You can also use the payment method “Sofort-Überweisung” from SOFORT GmbH, Fußbergstr. 1, 82131 Gauting, use. In principle, every internet user can use instant transfer as a payment method if they have an activated online banking account with a PIN/TAN procedure. You must note that instant transfer is not yet available at a few banks. If you use the “Sofortüberweisung” service, Upparel receives the transfer credit immediately, which speeds up order processing (shipping takes place after credit). All you need is your account number or IBAN, bank sort code, PIN and TAN. Using the secured payment form from SOFORT GmbH, www.sofortueberweisung.de automatically and in real time sets up a transfer in your online bank account. The purchase amount will be transferred immediately and directly to Upparel's bank account. This service is free of charge for you; you may only be charged the fees (transfer fees) from your bank.

      • Klarna purchase on account (Pay Later)

        In collaboration with Klarna Bank AB (publ), Sveavägen 46, 111 34 Stockholm, Sweden, we offer you purchase on account as a payment option. Please note that Klarna purchase on account is only available to Klarna users and payment must be made to Klarna.

        When you purchase on account with Klarna, you always receive the goods first and generally have a payment deadline of 14 days. You can find the complete terms and conditions for purchasing on account here .

        Data protection notice
        Klarna checks and evaluates your data and, if there is a legitimate interest and reason, exchanges data with other companies and credit reporting agencies. Your personal information will be treated in accordance with the applicable data protection regulations and in accordance with the information in Klarna's data protection regulations .

      • Credit card

        When you place your order, you also send us your credit card details. Once you have been authenticated as a legitimate cardholder, we will request your credit card company to initiate the payment transaction immediately after placing your order. The payment transaction is carried out automatically by the credit card company and your card is charged.

      • PayPal

        During the ordering process you will be redirected to the website of the online provider PayPal. In order to be able to pay the invoice amount via PayPal, you must be registered there or first register, identify yourself with your access data and confirm the payment instruction to us. After placing the order in the shop, we request PayPal to initiate the payment transaction. You will receive further information during the ordering process. The payment transaction will be carried out automatically by PayPal immediately afterwards.

      • Amazon Payments

        After clicking the “Pay with Amazon” button, you will be redirected to the website of the online provider Amazon before completing the ordering process in our online shop. In order to be able to process the ordering process via Amazon and pay the invoice amount, you must be registered there or first register and legitimize yourself with your access data. There you can choose the delivery address and payment method stored on Amazon, confirm the use of your data by Amazon and the payment instructions to us. You will receive further information during the ordering process. You will then be redirected back to our online shop, where you can complete the ordering process. Immediately after placing the order, we request Amazon to initiate the payment transaction. The payment transaction is carried out automatically by Amazon.

    6. Retention of title

      The goods remain our property until full payment.

    7. Transport damage

      If goods are delivered with obvious transport damage, please report such errors to the delivery person as soon as possible and please contact us immediately. Failure to make a complaint or contact us has no consequences whatsoever for your legal claims and their enforcement, in particular your warranty rights. However, you help us to be able to assert our own claims against the carrier or the transport insurance company.

    8. Warranty and Guarantees

      The statutory liability law for defects applies.     9. Out-of-court dispute resolution according to VSB

      From February 1, 2017, a new German regulation in the law on alternative dispute resolution in consumer matters (VSBG) will come into force. According to this, every consumer has the fundamental right to involve an entrepreneur in an out-of-court arbitration board in the event of disputes about a consumer contract that cannot be resolved amicably. Whether the entrepreneur is obliged to take part in the out-of-court dispute resolution procedure is determined by the law.

      We hereby expressly declare in accordance with Section 36 Paragraph 1 No. 1 VSBG that we are not obliged and therefore not willing to take part in an out-of-court dispute resolution procedure before a consumer arbitration board in accordance with the VSBG.
